The tragic death of two-year-old Awaab Ishak in December 2020, resulting from prolonged exposure to extreme mould in his home in Rochdale, has led to significant legislative changes in the UK social housing sector. 

In response, the government have introduced Awaab’s Law, aiming to transform the safety and quality of social housing.

Figures show that dampness and mould pose a serious threat to around 88,000 social housing properties in the UK.

The alarming number of current residents at risk highlights the urgent need for Mechanical Ventilation with Heat Recovery (MVHR) systems to prevent these issues.

Understanding Awaab’s Law and Its Impact on Housing Providers

Awaab’s Law mandates that social housing associations must investigate and rectify dangerous conditions like damp and mould promptly and effectively to safeguard tenant health.

The implementation of Awaab’s Law will occur in phases:

  1. From October 2025: Social housing providers are required to address significant damp and mould hazards within set timeframes and complete all emergency repairs within 24 hours.
  2. In 2026: The requirements will expand to cover a broader range of hazards beyond damp and mould, potentially including excess cold and heat, falls, structural collapse, fire, electrical issues, and hygiene hazards.
  3. By 2027: The law will encompass all remaining hazards as defined by the Housing Health and Safety Rating System (HHSRS), excluding overcrowding. The current list of hazards can be found here. the Housing Health and Safety Rating System (England) Regulations 2005.

A key aspect in preventing damp and mould problems is the proper installation and maintenance of Mechanical Ventilation with Heat Recovery (MVHR) systems.

These ventilation units are a necessity for blocks of flats, as they improve indoor air quality and prevent moisture buildup. 

However, without regular professional maintenance, MVHR systems can become ineffective, leading to poor air ventilation and potential non-compliance with the new legal standard.

Therefore, for housing associations (HAs) and local authorities (LAs), the introduction of this new legislation needs a proactive approach to building maintenance.
